1. ข้อตกลงนี้
ข้อตกลงการใช้บริการนี้เป็นสัญญาระหว่างคุณ (“ผู้ใช้”) กับ Kuidee ซึ่งดำเนินการโดย นายศุภฤกษ์ วินา (“Kuidee”, “เรา”) การสมัคร ลงทะเบียน หรือใช้บริการใด ๆ ของ Kuidee ถือว่าคุณยอมรับข้อตกลงนี้ทั้งหมด
2. ลักษณะบริการ
Kuidee เป็นแพลตฟอร์มซอฟต์แวร์ (SaaS) ที่รวมข้อความจากช่องทางต่าง ๆ (LINE OA, Facebook Messenger, Instagram DM, WhatsApp, เว็บแชท) ไว้ในกล่องข้อความเดียว พร้อมระบบ AI Auto-reply เพื่อช่วยธุรกิจขนาดเล็กและขนาดกลาง
3. บัญชีผู้ใช้
- ต้องมีอายุ 20 ปีบริบูรณ์ขึ้นไป หรือได้รับความยินยอมจากผู้ปกครอง
- ข้อมูลที่ให้ในการสมัครต้องเป็นความจริง ถูกต้อง และเป็นปัจจุบัน
- คุณเป็นผู้รับผิดชอบต่อกิจกรรมทั้งหมดภายใต้บัญชีของคุณ
- ต้องรักษารหัสผ่านเป็นความลับ และแจ้งเราทันทีหากพบการเข้าถึงโดยไม่ได้รับอนุญาต
4. การใช้งานที่อนุญาต
คุณตกลงจะไม่ใช้บริการในลักษณะดังต่อไปนี้:
- ส่งสแปม โฆษณาที่ลูกค้าไม่ได้ขอ หรือเนื้อหาผิดกฎหมาย
- ฉ้อโกง ล่อลวง หรือแอบอ้างเป็นบุคคลอื่น
- ละเมิดนโยบายของ Platform ใด ๆ (Meta, LINE, WhatsApp)
- พยายาม reverse-engineer, decompile หรือเข้าถึงระบบโดยไม่ได้รับอนุญาต
- ส่งไวรัส มัลแวร์ หรือโค้ดที่เป็นอันตราย
- เก็บรวบรวมข้อมูลผู้ใช้รายอื่นโดยไม่ได้รับอนุญาต
- ใช้บริการเกินกว่าที่แพ็กเกจกำหนด (rate limit, โควต้า AI reply)
การละเมิดอาจนำไปสู่การระงับบัญชีทันทีโดยไม่ต้องแจ้งล่วงหน้า
5. ช่องทางที่เชื่อมต่อ (Third-Party Integrations)
เมื่อคุณเชื่อมต่อ Facebook Page, Instagram Business Account, LINE OA, หรือ WhatsApp Business Account กับ Kuidee คุณรับรองว่า:
- คุณเป็นเจ้าของหรือได้รับมอบอำนาจให้จัดการบัญชีนั้น ๆ
- คุณปฏิบัติตามข้อกำหนดของแต่ละ Platform ได้แก่ Meta Platform Terms, LINE Official Account Guidelines, WhatsApp Business Messaging Policy
- คุณจะแจ้งลูกค้าของคุณว่าข้อความถูกประมวลผลผ่าน Kuidee
6. AI และความถูกต้องของคำตอบ
- Kuidee ใช้โมเดล AI ของบุคคลที่สาม (Anthropic Claude, OpenAI) ในการสร้างคำตอบ
- AI อาจให้คำตอบที่ไม่ถูกต้อง ไม่สมบูรณ์ หรือไม่เหมาะสมกับบริบทของลูกค้า
- คุณเป็นผู้รับผิดชอบในการตรวจสอบและแก้ไขคำตอบของ AI ก่อนส่งออก (โหมด AI_DRAFT) หรือหลังจากระบบส่งอัตโนมัติแล้ว (โหมด AI_AUTO)
- Kuidee ไม่รับผิดชอบต่อความเสียหายที่เกิดจากคำตอบของ AI ไม่ว่ากรณีใด ๆ
7. การชำระเงินและการยกเลิก
- แพ็กเกจ Trial ให้ฟรี 7 วัน พร้อมเครดิต AI จำนวน 100 ครั้ง
- แพ็กเกจชำระเงินคิดเป็นรายเดือนหรือรายปี ตามที่คุณเลือก โดยชำระล่วงหน้า
- รองรับการชำระผ่าน Stripe (บัตรเครดิต) และ Omise (PromptPay QR)
- คุณสามารถยกเลิกได้ทุกเมื่อ — การยกเลิกจะมีผลในรอบบิลถัดไป ไม่มีการคืนเงินในรอบที่ชำระไปแล้ว เว้นแต่กฎหมายกำหนดไว้เป็นอย่างอื่น
- หากระบบไม่สามารถเรียกเก็บเงินได้ Kuidee จะให้เวลา grace period ตามที่กำหนดในแต่ละแพ็กเกจก่อนระงับการใช้งาน
8. ข้อจำกัดความรับผิด
บริการนี้ให้บริการตามสภาพ “AS IS” และ “AS AVAILABLE” โดยไม่มีการรับประกันใด ๆ ทั้งโดยชัดแจ้งและโดยปริยาย Kuidee ไม่รับผิดชอบต่อความเสียหาย ทั้งทางตรงและทางอ้อม ที่เกิดจาก:
- การหยุดให้บริการของระบบ ไม่ว่าระยะเวลาใด ๆ
- การสูญหายของข้อมูลหรือข้อความ
- การเปลี่ยนแปลงนโยบายของ Platform (Meta, LINE ฯลฯ) ที่ส่งผลกระทบต่อบริการ
- คำตอบของ AI ที่ไม่ถูกต้อง
- ความล่าช้าของข้อความ หรือข้อความที่ส่งไม่สำเร็จ
ความรับผิดสูงสุดของ Kuidee จำกัดไว้ไม่เกินค่าบริการที่คุณชำระมา ในรอบ 3 เดือนก่อนเหตุที่เรียกร้อง
9. ทรัพย์สินทางปัญญา
ซอฟต์แวร์ โค้ด ดีไซน์ โลโก้ และเครื่องหมายการค้า “Kuidee” เป็นทรัพย์สินของ Kuidee ทั้งหมด คุณได้รับสิทธิ์ใช้งานเฉพาะเพื่อประโยชน์ของธุรกิจคุณตามข้อตกลงนี้เท่านั้น คุณคงความเป็นเจ้าของในข้อมูลและเนื้อหาที่คุณอัปโหลดเข้าระบบ
10. การเปลี่ยนแปลงข้อตกลง
Kuidee อาจปรับปรุงข้อตกลงนี้เป็นครั้งคราว หากมีการเปลี่ยนแปลงสาระสำคัญจะแจ้งให้ทราบล่วงหน้าอย่างน้อย 30 วัน การใช้บริการต่อหลังจากนั้นถือว่าคุณยอมรับข้อตกลงใหม่
11. กฎหมายที่ใช้บังคับและเขตอำนาจศาล
ข้อตกลงนี้อยู่ภายใต้กฎหมายแห่งราชอาณาจักรไทย หากเกิดข้อพิพาทใด ๆ ให้ศาลไทยมีเขตอำนาจ

1. Agreement
These Terms form a contract between you (“User”) and Kuidee, operated by Suparoek Wina (“Kuidee”, “we”, “us”). By registering, signing in, or using any Kuidee service you accept these Terms in full.
2. The Service
Kuidee is a SaaS platform that unifies messages from multiple channels (LINE OA, Facebook Messenger, Instagram DM, WhatsApp, and web chat) into a single inbox with an AI auto-reply engine designed for small and mid-sized businesses.
3. User Accounts
- You must be at least 20 years old or have parental consent
- Registration information must be true, accurate, and current
- You are responsible for all activity under your account
- Keep your password confidential and notify us of any unauthorised access
4. Acceptable Use
You agree NOT to use the service to:
- Send spam, unsolicited marketing, or illegal content
- Defraud, deceive, or impersonate any person
- Violate policies of any integrated platform (Meta, LINE, WhatsApp)
- Reverse-engineer, decompile, or gain unauthorised access to the system
- Transmit viruses, malware, or harmful code
- Harvest data about other users without consent
- Exceed the limits of your subscription plan (rate limits, AI reply quota)
Violations may result in immediate account suspension without notice.
5. Third-Party Platform Integrations
When you connect a Facebook Page, Instagram Business Account, LINE OA, or WhatsApp Business Account, you represent that:
- You own or are authorised to manage the connected account
- You comply with the respective platform terms (Meta Platform Terms, LINE Official Account Guidelines, WhatsApp Business Messaging Policy)
- You inform your customers that their messages are handled via Kuidee
6. AI Responses
- Kuidee uses third-party AI models (Anthropic Claude, OpenAI) to generate replies
- AI output may be inaccurate, incomplete, or contextually inappropriate
- You are responsible for reviewing AI output — either before it is sent (AI_DRAFT mode) or after (AI_AUTO mode)
- Kuidee is not liable for damages caused by AI responses
7. Billing and Cancellation
- The Trial plan is free for 7 days and includes 100 AI reply credits
- Paid plans are billed monthly or yearly in advance
- Payments via Stripe (credit card) and Omise (PromptPay QR)
- You may cancel at any time — cancellation takes effect at the end of the current billing period. No refunds for the current period unless required by law.
- If payment fails we apply a grace period per your plan before suspending the service.
8. Disclaimer and Limitation of Liability
The service is provided “AS IS” and “AS AVAILABLE” without warranty of any kind, express or implied. Kuidee is not liable for any direct or indirect damages arising from:
- Service downtime of any length
- Data or message loss
- Platform policy changes (Meta, LINE, etc.) that affect the service
- Inaccurate AI responses
- Delayed or undelivered messages
Our total liability is capped at the fees you paid in the three months preceding the event giving rise to the claim.
9. Intellectual Property
Software, code, design, logos, and the “Kuidee” trademark belong to Kuidee. You receive a limited licence to use them for your business under these Terms. You retain ownership of the data and content you upload.
10. Changes to the Terms
We may update these Terms from time to time. Material changes are announced at least 30 days in advance. Continued use after that constitutes acceptance of the new Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Kingdom of Thailand. Disputes are subject to the exclusive jurisdiction of Thai courts.
